What a minor child power of attorney is

A minor (child) power of attorney lets a parent or legal guardian give another adult temporary authority to make decisions for a child. This 2-page template appoints an agent to act "during any period of my absence or incapacity" and lets you choose, by initials, which decisions the agent may make. It does not transfer custody or end your parental rights; you keep the right to revoke or change it in writing at any time.

It is a general private template, not a state-issued form. Many states set their own limits on how long a parent can delegate authority and what can be delegated, and some publish their own forms.

Who typically uses it

Parents who will be traveling, deployed, hospitalized or working away from home and are leaving a child with a grandparent, relative or friend who may need to deal with schools or doctors. It is for children under the age of majority. A young adult who has reached that age signs their own documents, such as a medical power of attorney or a financial power of attorney, rather than a minor power of attorney.

What to have ready

  • Your full name and address as parent or guardian
  • The agent's full name and address
  • The child's full name and date of birth
  • The effective date and how long the authority should last
  • Two witnesses, and a notary if your state requires one

How to fill it out online with PDF Editify

Click "Fill Template Now", type into the fields, add initials and signatures, then download the PDF. For extra detail, read our minor child power of attorney guide. The fields:

  1. Date. The effective date.
  2. Principal and Agent. Your name and address, then the agent's name and address.
  3. Minor Child. The child's name and date of birth. If you have more than one child, check whether a separate form per child is clearer for schools and providers.
  4. Powers Granted. Initial each that applies: Healthcare Decisions, Educational Decisions, Financial Decisions, Travel Consent, Legal Decisions, Day-to-Day Care, and Other, where you describe any further power.
  5. Duration and Revocation. How long the power lasts. The form's own hint notes that, depending on the state, the maximum is usually 6 to 12 months.
  6. Signature and Date. Parent or guardian signature and date.
  7. Witnesses. Signature and date for Witness #1 and Witness #2.
  8. Agent Acceptance. The agent signs and dates to accept the role.

The template has witness lines but no notary block. If your state requires notarization, the notary will need to add an acknowledgment.

State limits and official forms

Examples as of October 2026:

  • New York lets a parent designate a person in parental relation for up to twelve months for health and education matters (N.Y. Gen. Oblig. Law 5-1551). A designation for more than thirty days must be notarized (section 5-1552).
  • Colorado courts publish a Delegation of Power by Parent or Guardian form under C.R.S. 15-14-105. It cannot grant power to consent to the child's marriage or adoption, is limited to 12 months, and is signed before a notary (Colorado Judicial Branch form JDF 751).
  • California uses a statutory Caregiver's Authorization Affidavit, which lets a caregiver 18 or older enroll a child in school and consent to school-related medical care, with broader medical authority for relatives (Cal. Fam. Code 6550).

Because the rules differ, check whether your state limits the duration, requires notarization or requires a specific form, and ask the child's school and doctors what they accept. If custody is disputed or a court order covers decision-making, get legal advice first.

Common mistakes

  • Setting a duration longer than your state allows
  • Initialing every power when only school and medical authority are needed
  • Leaving the child's date of birth blank
  • Forgetting the agent's acceptance signature
  • Not giving the agent, school and pediatrician a copy

Questions fréquentes

It is a document in which a parent or guardian gives another adult temporary authority to make decisions for a child, such as medical, school or travel decisions, without transferring custody.

It depends on the state. New York and Colorado, for example, limit these delegations to twelve months, and the form's hint notes that maximums are usually 6 to 12 months.

Some states require it. In New York a designation lasting more than thirty days must be notarized, and Colorado's court form is signed before a notary. This template has witness lines but no notary block.

Once a child reaches the age of majority, a minor power of attorney no longer applies. The young adult would sign their own financial or medical power of attorney instead.

Colorado's statute excludes consent to marriage or adoption, and other states set their own limits. Check your state's law before relying on the form for anything beyond day-to-day care.
