What the Spanish Form I-9 is
This template is the Spanish-language version of Form I-9, Verificación de Elegibilidad de Empleo (Employment Eligibility Verification), published by U.S. Citizenship and Immigration Services (USCIS). It is the 01/20/25 edition (OMB expiration 05/31/2027), the same edition as the current English form listed on the USCIS Form I-9 page as of October 3, 2026. The PDF has five pages.
Who may use the Spanish version
This is the most important point about this form. The Form I-9 instructions state that employers in the United States, except Puerto Rico, must complete the English-language version of Form I-9. Only employers located in Puerto Rico may complete the Spanish-language version instead of the English one.
Any employer may use the Spanish form and its instructions as a translation tool. In practice, that means an employer in Texas or Florida can give a Spanish-speaking new hire this version to read alongside the English form, but the form that is completed, signed, and kept on file must be the English version. If that is your situation, use our English Form I-9 template for the official record.
The I-9 is not a tax form and is not filed with USCIS or ICE. The employer keeps it.
What to have ready
- For the employee: legal name and other last names used, address, date of birth, and, depending on the status selected, an A-Number, USCIS Number, Form I-94 admission number, or foreign passport number and country of issuance.
- For the employer: the original documents the employee chooses to present (one from List A, or one from List B plus one from List C), the first day of employment, and the business name and address.
How to fill it out with PDF Editify
Click "Fill Template Now", type into the fields, then download and print. USCIS states on its I-9 page that the fillable I-9 must be printed and signed by hand, not typed or signed electronically, because the fillable PDF does not meet DHS standards for electronic I-9 systems.
Sección 1 (employee information and attestation)
The employee enters Apellido (Nombre de Familia), Primer Nombre (Nombre de Pila), Inicial de Segundo Nombre, Otros Apellidos Utilizados, address, date of birth, Social Security number, email, and phone. The instructions say the Social Security number is voluntary unless the employer uses E-Verify. The employee then selects one of four status boxes (U.S. citizen, noncitizen national, lawful permanent resident, or noncitizen authorized to work), fills in the matching number fields, and signs and dates by hand.
Sección 2 (employer review and verification)
The employer records each document's title, issuing authority, number, and expiration date under List A, or List B and List C, adds any additional information, checks the alternative procedure box only if it applies, and enters the first day of employment, the representative's name, title, signature, date, and the business name and address.
Supplements
Suplemento A is for a preparer or translator who helped with Sección 1. Suplemento B (formerly Section 3) is for reverification and rehire. Print these pages only when needed.
Deadlines and record keeping
Per the instructions, the employee completes Section 1 no later than the first day of employment, and the employer completes Section 2 within three business days after that day (or by the first day if the job lasts less than three business days). Employers keep the form for three years after the date of hire or one year after employment ends, whichever is later. There is no filing fee because the form is not filed with any agency.
Common mistakes
- Completing and keeping the Spanish version as the official record outside Puerto Rico.
- Typing or pasting signatures instead of printing and signing in ink.
- Selecting more than one status box, or asking the employee for specific documents.
- Missing the three business day deadline for Section 2.
- Mixing pages from different editions. Check the edition date at the bottom of each page.
