Form I-751 - Petition to Remove Conditions on Residence

Form I-751 is used by conditional permanent residents (married less than two years to a U.S. citizen/lawful permanent resident upon obtaining status) to upgrade to a 10-year green card. It must be filed jointly with the spouse within 90 days before the second anniversary of the conditional, 2-year green card.

What Form I-751 is

Form I-751, Petition to Remove Conditions on Residence, is the U.S. Citizenship and Immigration Services (USCIS) form a conditional permanent resident files when their status is based on marriage. It asks USCIS to remove the conditions so the resident can receive a permanent Green Card. This template is the 11-page edition 04/01/24, which is the edition listed on the official USCIS Form I-751 page as of October 3, 2026. USCIS says it may reject a form if any page is missing or comes from a different edition.

Who typically files it

The form has two filing paths, chosen in Part 3:

  • Joint filing, where the conditional resident files together with the U.S. citizen or permanent resident spouse (or, for a child, with the parent's spouse)
  • Waiver or individual filing request, where the conditional resident files alone for one of the reasons listed on the form, such as the spouse's death or a marriage that ended in divorce or annulment

When to file

As of October 3, 2026, the USCIS I-751 page states that joint filers must file during the 90-day period immediately before conditional residence expires, and a petition filed before that window opens may be rejected. Waiver requests can be filed at any time before conditional status expires. Your expiration date is printed on your conditional Green Card.

  • Your conditional Green Card, A-Number, and USCIS Online Account Number if you have one
  • Marriage date and place, and your current and past addresses
  • Your spouse's (or parent's spouse's) names, date of birth, A-Number or Social Security number, and address
  • Information about each of your children
  • The supporting evidence described in the Form I-751 instructions

Part 1. Information About You, the Conditional Resident

Names, A-Number, date your conditional residence expires, date of birth, marital status, date and place of marriage, mailing and physical addresses, and questions about immigration proceedings and other history.

Part 2. Biographic Information

Ethnicity, race, height, weight, eye color, and hair color, selected from checkboxes.

Part 3. Basis for Petition

Select one joint filing box (1.a. or 1.b.) or the applicable waiver boxes (1.c. to 1.g.). The waiver reasons on this edition include a deceased spouse, a good-faith marriage that ended in divorce or annulment, battery or extreme cruelty by the spouse or parent, and extreme hardship if status were terminated.

Part 4. Information About the U.S. Citizen or Lawful Permanent Resident Spouse

The spouse's or parent's spouse's names, date of birth, Social Security number, A-Number, and physical address.

Part 5. Information About Your Children

Each child's name, date of birth, and A-Number, whether the child lives with you, whether the child is applying with you, and the child's physical address.

Parts 6 to 11

Part 6 covers accommodation requests for disabilities or impairments. Part 7 is your statement, contact information, and signature. Part 8 is for your spouse's signature on a joint petition. Parts 9 and 10 are for an interpreter or preparer, and Part 11 gives extra space for longer answers.

Signing and filing

USCIS rejects unsigned forms, and the USCIS Policy Manual on signatures says typed names, software-generated signatures, and pasted signature images are not valid on paper filings. Print the form and sign Part 7 in ink. On a joint petition, your spouse signs Part 8 by hand too. A photocopy or scan of a form signed by hand is acceptable.

USCIS accepts Form I-751 online or by mail. For paper filings, the mailing address depends on where you live and is listed on the Direct Filing Addresses for Form I-751 page. Online filing starts with creating a USCIS online account.

Fees

USCIS sets the filing fee in its Fee Schedule (Form G-1055). Fees change, so confirm the current amount there before you pay. We do not list an amount here to avoid showing an outdated figure.

  • Filing a joint petition before the 90-day window opens
  • Missing the spouse's signature on a joint petition
  • Choosing both a joint filing box and a waiver box in Part 3
  • Using an older edition or leaving pages out
